Abundant Mindset

These Terms & Conditions ("Terms") govern your access to and use of the websites, free training, content, programs and services provided by Abundant Mindset Pty Ltd ATF Davis-Mouzakis Family Trust ("Abundant Mindset", "we", "us" or "our"). By accessing our website, opting in to our training, booking a call, or purchasing any program, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Eligibility
You must be at least 18 years old and able to enter into a legally binding agreement to use our services or purchase our programs. Our programs are directed to the audience described in our marketing and are not intended for minors.
2. Our Services
Abundant Mindset provides digital education, coaching and related content in the areas of mindset, identity, personal development and manifestation. Our services may include free training, video content, downloadable resources, live and recorded coaching, community access, and one-to-one sessions, as described on the relevant sales or program page at the time of purchase.
3. Nature of Our Programs — Important
Our programs are educational and personal-development services. They are not, and are not a substitute for, professional financial, legal, medical, psychological or other advice. You are solely responsible for the decisions you make and the actions you take in your own life, finances and career. See our separate Disclaimer for further important information, which forms part of these Terms.
4. Results and Guarantee
Any results, outcomes, case studies or testimonials referred to in our marketing or programs are illustrative only. They are not a promise or guarantee that you will achieve the same or similar results. Individual results depend on many factors, including your own effort, participation, circumstances and application of the material, and results are not typical.
Where we offer a specific guarantee for a program (for example, a money-back guarantee), the following applies:
● The guarantee, and the exact conditions that apply to it, will be set out on the relevant program or checkout page and/or in your coaching agreement at the time of purchase.
● Where a guarantee is based on a measurable outcome, that outcome is measured by the improvement in your score on our Dream Career Readiness Assessment (a scored self-assessment you complete at defined checkpoints), and not by any external result such as obtaining a particular job, role or income within a given timeframe. The specific score improvement required, and the checkpoints, are set out in your coaching agreement.
● Any guarantee is conditional on you meeting the stated participation requirements — which may include (without limitation) completing the program modules and workbook exercises, attending the required proportion of live calls and your scheduled sessions, submitting your practice tracker, completing all required assessments (including the baseline and closing assessments), making all payments on time, and proactively contacting us within the stated timeframe. If these conditions are not met, the guarantee does not apply.
● The guarantee sets out your sole and exclusive remedy in respect of the guaranteed outcome, to the extent permitted by law.
Nothing in this section limits or excludes any rights or remedies you have under the Australian Consumer Law that cannot be lawfully limited or excluded. See section 9 below.
5. Payment and Pricing
● All prices are stated on the relevant program page and are in the currency indicated. You are responsible for any taxes, fees or charges that apply to your purchase.
● Where you elect a payment plan, you authorise us (via our payment provider) to charge each instalment on the scheduled dates. You remain liable for the full program price.
● Payments are processed by third-party providers (such as Stripe and PayPal). By purchasing, you agree to their terms as well as ours.
● Except where a specific guarantee or a right under the Australian Consumer Law applies, payments are non-refundable once the program or its materials have been accessed.
6. Access and Licence
On purchase, we grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the program materials for your own personal use. You may not share, resell, reproduce, distribute or publicly post the materials, or provide your login credentials to any other person.
7. Intellectual Property
All content, materials, methods, frameworks, program names (including 'The Abundance Identity Method'), text, video, audio, workbooks and designs provided by Abundant Mindset are owned by or licensed to us and are protected by intellectual property laws. You obtain no ownership rights by purchasing or accessing our programs.
8. User Conduct and Community
Where a program includes community or group access, you agree to conduct yourself respectfully, to keep other participants' information confidential, and not to post unlawful, harmful, misleading or infringing content. We may remove content or remove or suspend your access if you breach these Terms, without refund where the breach is serious.
9. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the ACL where to do so would be unlawful. Where our liability can be limited under the ACL, our liability is limited (at our option) to re-supplying the services or paying the cost of having the services re-supplied.
10. Limitation of Liability
To the maximum extent permitted by law, and subject to section 9, Abundant Mindset is not liable for any indirect, incidental, special or consequential loss, or for any loss of profits, income, savings or opportunity, arising out of or in connection with our services or your use of them. To the maximum extent permitted by law, our total liability arising in connection with a program is limited to the amount you paid for that program.
11. Indemnity
You agree to indemnify us against any loss, damage, cost or expense we suffer arising from your breach of these Terms or your unlawful or improper use of our services, to the extent permitted by law.
12. Termination
We may suspend or terminate your access to our services if you breach these Terms. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and indemnity) will survive.
13. Governing Law
These Terms are governed by the laws of the State of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
14. Changes to These Terms
We may update these Terms from time to time. The current version will be available on our website with the 'Last updated' date shown. Your continued use of our services after changes take effect constitutes acceptance of the updated Terms.
